TELECOMMUNICATION operators in Bulgaria have been rescued from the obligation to hold public procurement tenders to purchase new equipment.
This is in terms of amendments to the Public Procurement Act adopted by Parliament last Thursday.
Following a heated debate, the MPs rejected a proposal to include a clause in the act binding mobile telephone operators to award public procurement contracts.
There is no need to include telecommunications in the bill because the market of telecommunication services is liberalised, Deputy Transport and Communications Minister Nedelcho Nedelchev told Parliament.
According to National Movement Simeon II MP Dimitar Lambovski, who proposed that mobile telephone operators should be included in the act, the adoption of his proposal would lead to a reduction in the prices of mobile telephone services.
Parliament decided that public procurement contracts should be awarded by the National Assembly, the President, the administrations of the Cabinet, the ministries, state committees and agencies, regional administrations, municipalities and law courts, including the Constitutional Court.
Medical treatment facilities with more than 30 per cent of their revenue coming from the national or municipal budgets in the previous year will also have to acquire their supplies through public procurement.
The Public Procurement Act will not apply to public procurement contracts related to defence and security, which contain classified information considered to be a state secret or when the execution of a public procurement contract involves the application of special security measures.
The public procurement provisions will not apply to public procurement contracts for services related to the manufacture of and trade in weapons, ammunition and military equipment. In such cases the conditions and the procedure for awarding the contracts will be established by an ordinance of the Cabinet issued in accordance with proposals from the Interior Minister or the Defence Minister.
Parliament raised the value thresholds for conduct of a public procurement award procedure.
Public procurement for construction will be awarded for contract to a value exceeding 1.8 million leva without VAT for performance inside Bulgaria and five million leva for performance abroad.
Public procurement procedure for supplies will be required for a contract of a minimum value of 150 000 leva without VAT inside Bulgaria and 250 000 leva when performed abroad. Services will have to be awarded by a public procurement procedure if the contract is valued above 90 000 leva inside Bulgaria and above 250 000 leva abroad.
