MAGISTRATES OPPOSE CONSTITUTIONAL CHANGES IN BULGARIA
09:04 Tue 06 Jun 2006

The magistrates from the Supreme Cassation Court (SCC) oppose the latest constitutional changes, according to which the National Assembly can dismiss the Prosecutor-General and the members of the Supreme Cassation Court and the Supreme Administrative Court.

Constitutional changes that Parliament approved, enable magistrate dismissal with a two thirds parliamentary vote, BGNES news agency reported. The SCC said that the changes violated the independence of the judicial system.

Darik Radio reported that the SCC also opposed the increased authority of the Justice Minister.

In a letter to the Constitutional Court SCC requested the re-viewing of the changes, saying the new laws allowed direct legislative power influence over the judicial system.

According to the new laws the National Assembly can control and intervene in the work of the courts, creating opportunities for dismissals based on political motives, Darik Radio said.

The European Commission warned that Constitution changes would limit the justice sector. EC experts recommended a new set of amendments, which would be discussed with Bulgarian officials.
