Bulgaria criticised by EC for failure to comply with GMO ban

The European Commission has criticised Bulgaria for its failure to comply with rules and regulations pertaining to the Genetically Modified Organism (GMO) ban, threatening that the country has two months to come to heel or face the European Court of Justice, the EC website reported on March 14 2011.

The complaint stems from the fact that Bulgaria has failed to meet the Directive's requirements and implement adequate measures curtailing possible risk to human health and the environment.

Almost exactly a year ago, Bulgaria effectively banned all cultivation of GMO products. The ban was enacted on March 18 2010.

The European Commission has thus said that Bulgaria has two months to report about measures taken to implement the Directive correctly, the report said.

"The manner in which Bulgaria has implemented the Directive fails to control all possible risk to human health and the environment," the letter to Bulgaria said.

"Bulgaria has also failed to legally provide for its obligation to send the Commission annual reports on certain activities".

In response to the Commission launching an investigation on 15 April 2010, Bulgaria amended its GMO act, but the new provisions failed to compensate for the drawbacks in the national legislation identified by the Commission.
