EC interim report on Bulgaria judiciary would not recommend safeguard clause - radio

The European Commission interim report on the state of Bulgaria’s judiciary and law enforcement will come out on July 22 2009 and will not recommend invoking a safeguard clause in the country's European Union accession treaty, Bulgarian National Radio (BNR) said on July 9 2009.

The report's publication date will coincide with the week when the newly-elected Parliament is expected to approve Boiko Borissov's cabinet whose party GERB won a landslide victory at the July 5 2009 elections ousting the tripartite coalition Government of Bulgarian Socialist Party leader Sergei Stansihev.

"The coinciding of the two events is not intentional," BNR said.

The report will criticise Bulgaria's inability to fight corruption, BNR said. However, the EC decided that a possible safeguard could have a negative effect on judicial reforms, hence its decision no to recommend one, BNR said.

Instead, the EC would recommend the continuation of the monitoring mechanism in the form of interim reports that have proved useful.

Another report on Bulgaria's ability to absorb European Union funds will be completed by October. A similar report will be done on Romania who, together with Bulgaria, joined the EU in 2007.

In September and October, the EU member states will review the reports' outcomes and decide if there is a need for safeguards, BNR said.  According to the two country's EU accession treaties, safeguard clauses can be invoked during the first three years of their EU membership, a period that expires at the end of 2009.
